3. Payment Terms

  • Payment is required at the time of order.
  • We accept major credit cards and any additional payment methods shown at checkout.
  • Orders are subject to final approval and availability.
  • Title and risk of loss transfer to the buyer once the carrier picks up the shipment.

4. Product Condition & Surplus Disclaimer

Critical Surplus specializes in surplus industrial parts and components. Many items sold on this site may be Unused Surplus, Open Box, Refurbished, Used, Salvage, or Sold As-Is.

  • Unused Surplus / Open Box: Items are unused but may not include original manufacturer warranties.
  • Refurbished: Items have been tested and verified for functionality but may show signs of handling or prior use.
  • Used / Salvage / Sold As-Is: Items are sold without warranty and may require repair, parts, or full refurbishment.

Critical Surplus is not an authorized distributor or representative of any manufacturer unless specifically stated. Manufacturer warranties generally do not apply to surplus products.

5. Shipping & Delivery

Shipping, delivery estimates, processing times, and damage-reporting requirements are governed by our Shipping Policy.

  • Delivery dates are estimates and not guaranteed.
  • We are not liable for delays caused by carriers, weather, labor shortages, or other conditions outside our control.
  • Freight shipments must be inspected upon delivery; concealed damage must be reported promptly.
  • We reserve the right to cancel or refund orders if an item is out of stock or unavailable.

6. Returns, Refunds & Warranty

Returns, refunds, restocking fees, defective item claims, and our 90-Day Limited Guarantee are governed by our Returns & Warranty Policy.

  • Returns require prior authorization (RMA number).
  • Returns not due to our error may be subject to a restocking fee.
  • Customer is responsible for return shipping costs for non-defective items or ordering errors.
  • Warranty applies only to items sold as Unused Surplus, Open Box, or Refurbished.

7. Disclaimer of Warranties

Except as expressly stated in our 90-Day Limited Guarantee, all products are provided "AS-IS" and "WITH ALL FAULTS."

Critical Surplus makes no representation or warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, performance, safety, or compliance with electrical codes.

8. Limitation of Liability

Under no circumstance will Critical Surplus be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to:

  • Loss of profits or revenue
  • Business interruption
  • Property damage
  • Installation-related damages
  • Personal injury resulting from improper use or installation

Buyer assumes all responsibility for installation, use, suitability, and compliance with local electrical and safety codes.

9. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the State of New Jersey, USA. Any dispute arising from the use of this website or the purchase of goods must be brought exclusively in the federal or state courts located in New Jersey.

10. Modifications to This Agreement

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Changes will be posted to this page, and continued use of the website constitutes acceptance of the revised terms.

11. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force.
